LEGALESE: WHAT’S WITH THIS ACT?

Age Discrimination in Employment Act (ADEA) – A federal law that protects employees over 40 years old from discrimination, harassment, and retaliation. California also protects employees over 40 years of age under its employment discrimination/harassment/retaliation law known as the Fair Employment and Housing Act (FEHA).
Americans with Disabilities Act (ADA) – A law that protects the civil rights of those with disabilities. California has several laws that protect disabled people, but the one that protects disabled employees is the Fair Employment and Housing Act (FEHA).
Consolidated Omnibus Budget Reconciliation Act (COBRA) – A law that allows for an employee covered by an employer’s healthcare plan to continue that medical coverage after termination or another qualifying event.
Equal Pay Act (EPA) – A law that requires employers to pay men and woman equally for substantially similar jobs. California has an Equal Pay Act, but it includes race and ethnicity too.
Fair Labor Standards Act (FLSA) – A law that requires employers to pay non-exempt workers the federal minimum wage, overtime when an employee works more than 40 hours in a week, and record keeping requirements. California has much stricter minimum wage and overtime requirements.
Family and Medical Leave Act (FMLA) – A law that requires businesses to provide up to 12 weeks of unpaid leave for employees to take care of their own serious health conditions, serious health conditions of some relatives, and for bonding with a newborn, adopted child, or foster child. The California Family Rights Act is similar but is less restrictive than the FMLA.
National Labor Relations Act (NLRA) – A law that provides for private sector employees to organize into trade unions, engage in collective bargaining, and take collective action.
